As the title & escrow company handling your settlement, Eastern Title & Settlement will conduct land record, lien, judgment, court and other searches to confirm you have the right to sell the subject property and determine what requirements need to be satisfied in order for you to convey good title to the buyer. We handle the funds, prepare closing documents, and issue title insurance policies — acting as a neutral intermediary who helps both sides close in accordance with the sales contract. Here are a few additional issues to consider:

Identification

All sellers will need to provide a valid, government-issued form of photo identification such as a driver license or passport. No ID, no closing.

Corporate Issues

If the seller is an entity (LLC, corporation, etc.), we will need formation/operating/good standing documents. The selling entity must identify who will sign on its behalf. We can’t close without complete corporate documentation.

Estates

If the seller is an estate, we will need copies of the estate paperwork, including the decedent’s death certificate, the List of Interested Persons, and the Letters of Administration or other court-appointed fiduciary document.

Surveys

If the buyer requests it, a licensed surveyor will prepare a location drawing or boundary survey. They may need your help obtaining full access to the property. Any title defect discovered will be brought to your attention.

Title Insurance

Our title insurance commitment will be made available to the seller upon request. When we discover material title issues that cannot be resolved prior to closing, all parties will be notified.

Settlement

The contract may contain a “settlement date” but until all conditions are confirmed by all parties, settlement has not been scheduled. Eastern Title is not responsible for collecting earnest money, forcing parties to close, or resolving contract disputes.

Pre-Signing

If you would like to pre-sign settlement documents, that can be arranged. Contact us for more information about pre-signing.

Funds

Please be careful with your funds. There are those who try to take advantage of sellers by diverting sale proceeds. We will never change wire instructions in the middle of a transaction.

We'll need you to complete our Seller Information Form as soon as possible to move your file forward to closing.

If the seller is an entity (LLC, corporation, etc.), we will need formation/operating/good standing documents. The selling entity will also need to identify who will be signing closing documents on its behalf. We can help with templates for corporate, LLC resolutions. We can't close without complete corporate documentation.

Estates

If the seller is an estate, we will need copies of the estate paperwork, including the decedent's death certificate, the List of Interested Persons, and the Letters of Administration or other document from the court appointing a fiduciary to act on behalf of the Estate seller. You can save the expense of us retrieving copies from the court.

Surveys

If the buyer requests it, a licensed surveyor will be engaged to prepare a location drawing or boundary survey. They may need your help obtaining full access to the property to complete their work. Anything constituting a title defect which is discovered by the surveyor will be brought to your attention.

Title Insurance

Our title insurance commitment will be made available to the seller upon request. When we discover material title issues that cannot or will not be resolved prior to closing, all parties will be notified so the issue can be considered in the context of the contract terms.

Settlement

The sales contract may contain a “settlement date” but until all contract conditions have been satisfied and the exact time and place of settlement has been confirmed by all parties, settlement has not been scheduled. We cannot control if and when buyers fund and close. Please be aware that Eastern Title is not responsible for collecting earnest money, forcing parties to close or resolving contract disputes.
